WELCOME TO SHAIR

Welcome to Shair Salon [ABN 84 364 377 601] (Shair, we, us or our). We’re excited to have you here! Shair is a web-based platform available at www.shair.com.au (the Platform) that lets you complete a hair quiz to build your personalised hair profile, and share it with hairdressers and salons to help you get the best results in the chair.

By creating an account, completing a quiz, or otherwise using our Platform, you agree to be bound by these Consumer Terms of Use (Terms). These Terms form a binding agreement between you and Sharon Douglas t/as Shair Salon (and) Shair Quiz. If you don’t agree to these Terms, please don’t use the Platform.

We may update these Terms from time to time. If we make material changes, we’ll let you know by posting a notice on the Platform or emailing you. Your continued use of the Platform after any changes means you accept the updated Terms.



1. DEFINITIONS

In these Terms, unless the context otherwise requires:

Account means your registered user account on the Platform.

Content means any text, images, data, information, quiz questions, quiz results, graphics, designs, logos, icons or other material displayed on, generated by, or available through the Platform.

Hair Profile means the personalised summary of your hair characteristics, preferences and quiz results generated through the Platform.

Intellectual Property means all intellectual property rights including copyright, trade marks, designs, patents, domain names, trade secrets, know-how and all other similar rights.

Loss or Damage means any loss or damage of any kind, including loss of revenue, loss of profit, loss of goodwill, loss of data, loss or damage to reputation, personal injury, property damage or legal costs, whether direct, indirect, special or consequential.

Platform means the Shair web application available at www.shair.com.au and any related services.

Quiz means the hair consultation quiz available through the Platform.

Salon means a hairdresser, hair salon, or hair professional registered on the Platform to receive Hair Profiles from consumers.

User Content means any content you upload, submit or share through the Platform, including photographs, images and text.



2. ELIGIBILITY AND ACCOUNT REGISTRATION

Age requirement

You must be at least 16 years of age to create an Account and use the Platform. By creating an Account, you confirm that you are at least 16 years of age. During registration, you will be required to check a box confirming: "I confirm that I am at least 16 years of age." If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Platform. We do not knowingly collect personal information from anyone under 16 years of age. If we become aware that a user is under 16 and has not obtained parental or guardian consent, we will disable that Account and delete their data.

Account registration

To use certain features of the Platform, you will need to create an Account by providing a valid email address and creating a username and password. You agree to:

  1. provide accurate, current and complete information during registration;
  2. maintain and update your information to keep it accurate and current;
  3. keep your login credentials confidential and not share them with anyone;
  4. notify us immediately at hello@shair.com.au if you suspect any unauthorised use of your Account.

You are responsible for all activity that occurs under your Account. We are not liable for any Loss or Damage arising from your failure to keep your login credentials secure.



3. THE QUIZ AND HAIR PROFILE

How it works

The Platform allows you to complete a Quiz by answering a series of questions about your hair type, thickness, length, face shape, existing colour, desired colour, and style preferences. Based on your answers, the Platform generates a Hair Profile that summarises your hair characteristics and preferences.

Sharing your Hair Profile

You can choose to share your Hair Profile with one or more Salons registered on the Platform. Once you share your Hair Profile with a Salon, that Salon will be able to view the information contained in your Hair Profile through their dashboard. You control which Salons receive your Hair Profile.

Important limitations — please read carefully

The Quiz and Hair Profile are provided for informational and educational purposes only. The Platform is designed to help you understand and communicate about your hair with hair professionals. It is not intended to and does not:

  1. diagnose any medical or scalp condition;
  2. recommend or prescribe any medical treatment;
  3. replace a face-to-face consultation with a qualified hair professional;
  4. guarantee any particular outcome or result from a hair service; or
  5. replace the professional judgement, training or expertise of a hairdresser.

Where the Quiz relates to hair colour, you acknowledge that you should always speak to your hair professional regarding a skin patch test prior to any colour service. You should always rely on the in-person assessment and professional advice of your hairdresser, not solely on the information in your Hair Profile.



4. IMAGE UPLOADS

The Platform allows you to upload photographs, including inspirational images or images of your own hair (Uploaded Images). By uploading images to the Platform, you:

  1. grant us a non-exclusive, royalty-free, worldwide licence to store, display and transmit your Uploaded Images for the purpose of providing the Platform services, including sharing your Hair Profile with Salons;
  2. represent and warrant that you own or have the necessary rights, licences and permissions to upload the images and to grant us the licence above;
  3. acknowledge that you are solely responsible for the content and legality of any images you upload; and
  4. acknowledge that we do not analyse images for diagnostic purposes.

We reserve the right to remove any Uploaded Images that we consider, in our sole discretion, to be inappropriate, offensive, or in breach of these Terms.



5. INTELLECTUAL PROPERTY

Our Intellectual Property

All Intellectual Property in the Platform, the Quiz, the Quiz content, the underlying algorithms, designs, software, text, graphics, logos and all other Content (excluding User Content) is owned by or licensed to us. You must not reproduce, modify, distribute, display, sell, or create derivative works from any of our Content without our prior written consent.

Your Hair Profile and User Content

You retain ownership of any User Content you upload to the Platform. Your Hair Profile data belongs to you, and you may request deletion of your Hair Profile and Account data at any time in accordance with our Privacy Policy.

You grant us a non-exclusive, royalty-free licence to use, store, display and transmit your User Content and Hair Profile data solely for the purpose of operating the Platform and providing our services to you.



6. ACCEPTABLE USE

We want the Platform to be a positive experience for everyone. When using the Platform, you must not:

  1. provide false, misleading or inaccurate information;
  2. use the Platform for any unlawful purpose or in any way that breaches any applicable law;
  3. upload any content that is offensive, defamatory, obscene, threatening, or infringes the rights of any third party;
  4. attempt to gain unauthorised access to the Platform, other user accounts, or any systems or networks connected to the Platform;
  5. use any automated means, including bots or scrapers, to access, collect data from, or interact with the Platform;
  6. interfere with or disrupt the Platform or its servers or networks;
  7. impersonate any person or entity; or
  8. use the Platform for any commercial purpose, advertising or self-promotion without our prior written consent.



7. CONSUMER GUARANTEES

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.

For services that are not supplied to you as a ‘consumer’ within the meaning of the Australian Consumer Law, our liability for breach of any implied warranty or condition that cannot be excluded is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.



8. DISCLAIMERS AND NO WARRANTIES

Subject to clause 7, we make no warranties or representations about the Platform or its Content. To the maximum extent permitted by law:

  1. we do not guarantee that the Platform will always be available, that your use will be uninterrupted, or that the Platform is free from errors, viruses or security vulnerabilities;
  2. we do not guarantee the accuracy, completeness, reliability or suitability of the Quiz results, Hair Profiles, or any other Content;
  3. we do not endorse, guarantee or take responsibility for the quality, safety or suitability of any services provided by any Salon;
  4. we do not guarantee any particular outcome from sharing your Hair Profile with a Salon; and
  5. you acknowledge and agree that there is a risk of data breaches and that no system is completely secure.

9. LIMITATION OF LIABILITY AND INDEMNITY

Limitation of liability

Subject to clause 7, we exclude, to the maximum extent permitted by law, any liability in connection with your use of the Platform, the Quiz, any Hair Profile, any Content, or any services provided by a Salon. We are not responsible for any Loss or Damage suffered in connection with:

  1. your use of, or reliance on, the Platform, the Quiz results, or any Content;
  2. any acts or omissions of a Salon, including any hair services provided;
  3. any User Content uploaded by you or any other user;
  4. any interruptions, changes, suspension or termination of the Platform; or
  5. any events beyond our reasonable control.

Indemnity

You indemnify us and our employees, agents, partners and contractors against any claim, demand, loss, damage, cost or expense (including legal costs on a full indemnity basis) arising out of or in connection with:

  1. your use of the Platform;
  2. your breach of these Terms;
  3. your breach of any applicable law; or
  4. your User Content, including any claim by a third party that your User Content infringes their rights.



10. ACCOUNT TERMINATION AND DATA DELETION

Your right to terminate

You may close your Account at any time by contacting us at hello@shair.com.au. Upon closure, we will delete your Account data, Hair Profile data and User Content in accordance with our Privacy Policy.

Our right to terminate or suspend

We may suspend or terminate your Account and access to the Platform at any time, with or without notice, if:

  1. you breach these Terms;
  2. you engage in conduct that is harmful, fraudulent, or unlawful;
  3. we are required to do so by law; or
  4. we decide to discontinue the Platform or any part of it.

Data storage: Your personal data and Account information is stored on servers located in Australia. We will notify you if this changes in accordance with our Privacy Policy.

Data deletion

You have the right to request deletion of your personal data at any time. For details on how we handle your data, please see our Privacy Policy at www.shair.com.au/privacy.



11. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites or services that are not owned or controlled by us. We provide these links for your convenience only. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party websites or services. We do not endorse them in any way, and your use of those websites or services is at your sole risk.



12. CHANGES TO THE PLATFORM

We may change, suspend, or discontinue the Platform (or any part of it) at any time without notice. We will not be liable to you or any third party for any modification, suspension or discontinuance of the Platform.



13. GENERAL

Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, for any dispute arising out of or in connection with these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

Waiver

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Entire agreement

These Terms, together with our Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and us in relation to your use of the Platform.

Survival

The obligations and liabilities in these Terms that by their nature should survive termination will survive, including clauses 5, 7, 8, 9 and 13.
